Arbitration involves the resolution of disputes outside of the usually chronically delayed Irish Court system. It involves the hearing of issues between parties before an appointed expert, whose findings and determination can form a legally binding agreement. There are many benefits to arbitration, namely that the parties have control over the speed of the process, proceedings are kept private and it is less costly than court proceedings.
Mediation is broadly similar to arbitration where an attempt is made to resolve a dispute before an independent third party, without recourse to the Courts and where such a determination is also legally binding. This is also a very advantageous and less costly option to court litigation.
