A Court is empowered to make the following orders in cases of Domestic Violence:
- Safety Order– This does not put the offender out of the home, but it prevent them from using or threatening to use violence, molest or put fear in the Applicant or any other dependant person. A Safety Order may be made for up to 5 years;
- Barring Orders– This directs the offending Spouse or partner to leave the property where the Applicant also lives and prevents them from re-entering until such time as a Court directs. This type of order can have validity for up to 3 years.
- Protection Orders– This does not put the offending Spouse or Partner out of the family home but directs them not to use violence or implement a threat of violence against, molest or put fear in the Applicant or any dependant person. This is an interim measure and is only in effect until the hearing of the barring or safety order.
